DMCA & Copyright Policy
Cubed News (cubednews.com) respects the intellectual-property rights of others and expects our readers and contributors to do the same. This policy explains how to notify us if you believe content on our site infringes your copyright, and how the process works. It follows the framework of the United States Digital Millennium Copyright Act (DMCA) and reflects the principles of copyright law more broadly.
Our Commitment
We aim to publish only material we own, have licensed, or are entitled to use under fair-use and fair-dealing principles. If we have made a mistake, we will act on a valid notice promptly. We also reserve the right, in appropriate cases, to disable access to or remove material that is the subject of a credible infringement claim, and to terminate access for repeat infringers.
Filing a Takedown Notice
If you are a copyright owner, or are authorised to act on behalf of one, and you believe material on Cubed News infringes your copyright, please send a written notice to our designated agent. To be valid, your notice should include the following:
- Your physical or electronic signature, as the owner or an authorised representative.
- Identification of the copyrighted work you claim has been infringed, or, if multiple works are covered by a single notice, a representative list.
- Identification of the material you claim is infringing, with enough detail — ideally the exact URL on cubednews.com — for us to locate it.
- Your contact information: name, postal address, telephone number, and email address.
- A statement that you have a good-faith belief that the disputed use is not authorised by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the owner or are authorised to act on the owner’s behalf.
Send your notice to our designated copyright agent at legal@cubednews.com, with “DMCA Notice” in the subject line, or by post to Cubed News, Attn: Copyright Agent, 1222 Clarence St, Sydney, Australia.
What Happens Next
When we receive a notice that complies with the requirements above, we will review it and, where appropriate, remove or disable access to the material in question. We may notify the person who posted or supplied the material that it has been removed, and we may forward your notice to them, including your contact details. We will respond to good-faith notices in a reasonable time.
Counter-Notice
If you believe material of yours was removed by mistake or misidentification, you may submit a counter-notice to the same agent. A valid counter-notice should include your signature; identification of the material that was removed and the location where it appeared before removal; a statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification; your name, address, and telephone number; and a statement that you consent to the jurisdiction of an appropriate court and will accept service of process from the party who filed the original notice. Where the law requires, we may restore the material after a defined waiting period unless the original complainant files a court action.
Misuse of This Process
Filing a knowingly false or bad-faith notice — whether a takedown or a counter-notice — may expose you to liability for damages under the DMCA and other applicable law. Please use this process responsibly and only where you have a genuine, good-faith claim. If your concern is not a copyright matter — for example a factual correction or a privacy request — please contact us through the appropriate channel on our Contact page rather than filing a copyright notice.
